OSHA Penalty Estimator
A free estimator that totals the maximum federal OSHA civil penalty exposure for a set of citations, using the 2026 penalty amounts. You enter how many violations of each type and it adds up the worst case.
The estimate is the count of each violation type × the maximum penalty for that type: $16,550 per serious violation, $16,550 per other-than-serious violation, $165,514 per repeat violation, $165,514 per willful violation (the willful minimum is $11,823), and $16,550 per day for failure to abate past the abatement date. These are maximums. OSHA's proposed penalty uses a gravity-based system with reductions for employer size, good faith and inspection history, so the assessed amount is often lower. The amounts adjust for inflation each year. The tool is for education and is not legal advice.
How to use it
- Enter the number of serious, other-than-serious, repeat and willful violations.
- Enter the number of days past the abatement date for any failure to abate.
- Read the amount for each line and the estimated maximum exposure.
